Thailand: Royal Decree No. 759 – Exemption of data center businesses from VAT

Royal Decree No. 759 was issued in the Official Gazette of Thailand. The bill allows data center operators to claim a VAT exemption for their businesses. The Thai government recognized how important the data center industry and data hosting services are, which will make more people to invest in this field.

 

The VAT exemption applies to data hosting services such as:

 

  • Servers and associated devices for storing, processing, and connecting electronic data across the internet and
  • Informational resources to offer
  • cloud or internet connections,
  • management and security services, and
  • sites for disaster recovery.

 

Businesses can apply for VAT exemption within a five-year period beginning 9th November 2022, and ending 8th November 2027. The exemption also says that the data operators must be registered for VAT and follow all the rules for a legal corporation or partnership in Thailand.
