Sweden: Improvement of VAT guidelines and equalization of input tax

The Swedish Tax Agency released the improved VAT guidelines and input tax equalization in the event of property and business transactions.

 

The improved VAT guidelines cover the following:

 

  • the transfer of tax liabilities, rights, and duties for any input tax adjustments if there is a chance of a voluntary tax debt unrelated to the sale of a business;
  • business transfer evaluations;
  • the rights and obligations for input tax adjustment when a voluntary tax liability is associated with a business transfer;
  • agreements between the transferor and the purchaser regarding adjustments are subject to limitations;
  • the property transfers are exempt from voluntary tax liability;
  • leasing-related voluntary tax obligations;
  • transferors’ duty to modify input tax deductions upon a change in use that takes place while they are in possession in the case of a property transfer unrelated to a business transfer, and;
  • right of transferors to act in this way whenever the deduction would grow in all circumstances.
