Philippines: Court denies VAT refund claim on zero-rated service sales

The Philippine Court of Tax Appeals issued a decision in CTA Case No. 10248, addressing the refundability of input value-added tax (VAT) related to zero-rated sales of services. The case involved a Philippine regional headquarters of a Swiss company that was registered as a VAT taxpayer and provided various business services.

 

  • The taxpayer submitted quarterly VAT returns in 2017, seeking a refund for unutilized input VAT attributed to its zero-rated service sales.
  • The Commissioner of Internal Revenue (CIR) denied the claim, citing insufficient evidence to support the taxpayer’s entitlement to a refund.
  • Upon appeal, the Court of Appeals upheld the CIR’s decision, concluding that the taxpayer did not:
    1. Adequately substantiate its refund claim at the administrative level or meet mandatory invoicing requirements.
    2. Prove its zero-rated sales, inward remittance of payments through the Philippine banking system, or compliance with central bank regulations.
    3. Provide sufficient documentation for an offsetting arrangement concerning certain foreign currency payments.

 

As a result, the court denied the taxpayer’s petition for review.
