Kenya: Digital Services Tax abolished as of December 27, 2024

Kenya has officially repealed the Digital Services Tax (DST) effective December 27, 2024. This decision comes as the country prepares to implement a new tax framework, the Significant Economic Presence (SEP) tax, which is still under discussion with the Organisation for Economic Co-operation and Development (OECD).

Key updates:

 

  • Exclusion of invoices: Any invoices issued on or after December 27, 2024, should not be included in the December DST return.
  • Tax reporting: Invoices for the remaining days of December will be reported along with January sales under the SEP tax.
  • System enhancements: Upgrades are underway to incorporate SEP tax functionality into the iTax portal. Authorities will provide updates as the new system becomes operational.
