In a significant regulatory update on the 15th April 2025, the Italian Revenue Agency (Agenzia delle Entrate) has introduced a new requirement that will impact non-EU businesses wishing to conduct intra-community transactions within the European Union. Effective immediately, companies outside the EU/EEA must now provide a financial guarantee to register for VAT and remain listed in the VIES database – an essential step for EU-wide VAT compliance.
Starting from the publication of the new provisions, non-EU/EEA businesses that wish to perform VAT-related activities in Italy must provide an appropriate guarantee. This guarantee is a legal requirement under Article 35, Paragraph 7-quater of the Presidential Decree No. 633/1972. The goal is to ensure businesses comply with VAT obligations while operating in Italy and across the EU.
Businesses can provide the following types of guarantees:
– Security deposits in government bonds or state-backed securities.
– Bank guarantees or insurance surety bonds. The minimum guarantee value is €50,000.
– The minimum value of the guarantee is €50,000.
Key deadline: Businesses that are already listed in the VIES database have until 13 June 2025 to submit the guarantee. After this period, if the guarantee is not provided, they will be excluded from the VIES database.
