India will abolish its 2% equalisation levy on digital companies, online education providers, and software-as-a-service firms without a physical presence in the country, effective August 1. The finance minister announced this decision, which is expected to enhance tax compliance, according to experts.
The levy, introduced on April 1, 2020, was imposed on e-commerce companies with annual business exceeding Rs 2 crore with Indian entities if they lacked a physical presence in India and their income was not classified as royalty. The existing 6% equalisation levy on specified digital services, such as online advertising, will remain in effect.
Taxation experts have welcomed the move, noting that the compliance costs for foreign entities were significant and impacted tax collection integrity. However, with the abolition of the levy set for August 1, questions arise regarding its applicability for July, given the due date for payment is August 7. Experts are calling for government clarification on this issue.
